DUCSU polls: Pause on HC stay order extended till hearing on Wednesday
The Supreme Court's chamber court on Tuesday extended its suspension of a High Court (HC) stay order that deferred elections to the Dhaka University Central Students’ Union (DUCSU) for more than two months.
The chamber court of Justice Farah Mahbub also set Wednesday for holding the next hearing on a writ petition which started the legal debacle.
The hearing will be at the top of the Appellate Division's agenda on Wednesday, confirmed Advocate Shishir Monir, legal counsel for the university, on Tuesday.
Earlier on Monday, the High Court suspended the DUCSU election until 30 October in response to a writ petition filed by a leftist election candidate challenging the candidacy of Chhatra Shibir leader SM Farhad.
The HC instructed the petitioner to file a complaint against Farhad with the DU Election Tribunal within 15 days. The court ordered her to provide all the necessary valid documents to back up her allegations that Farhad holds anti-Liberation War sentiments, and, with no visible record on submitting a resignation letter, continues to be a member of Chhatra League, a student group banned last year for its terrorist activities.
However, immediately after the HC ruling, Advocate Shishir Monir rushed to the Chamber Court of the Appellate Division with a handwritten petition. He presented arguments convincing the court that the High Court’s order had a legal flaw.
Considering the urgency and sensitivity of the matter, Justice Farah Mahbub stayed the High Court order within just an hour.
As a result, the legal barrier to holding the DUCSU election was removed.
