No bar to hold DUCSU polls on 9 September
The Appellate Division of the Supreme Court has upheld the chamber court order, suspending the High Court order over the Dhaka University Central Students’ Union (DUCSU) elections.
As a result, there is no legal bar to holding the DUCSU elections on 9 September as per the schedule.
The full Appellate Division bench, headed by Chief Justice Syed Refaat Ahmed, passed the order on Wednesday (3 September) afternoon after hearing.
Earlier in the day, the hearing commenced on the appeal filed against the High Court’s verdict that postponed the DUCSU elections.
Advocate Mohammad Shishir Monir represented Dhaka University in the hearing.
Earlier on Tuesday (2 September), the Supreme Court’s chamber judge extended until Wednesday morning its earlier order that stayed a High Court (HC) directive suspending the DUCSU election until October 30.
Justice Farah Mahbub of the Appellate Division extended the order following a petition by Dhaka University authorities seeking a stay on the HC ruling.
The chamber court also sent DU’s petition to its regular bench for hearing on Wednesday morning.
Earlier on 1 September, the High Court stayed the DUCSU elections until October 30. The court also directed the Dhaka University's elections tribunal to dispose of the issues regarding the political background of SM Farhad, general secretary candidate from the Islami Chhatra Shibir-backed panel in DUCSU elections. The HC also asked the tribunal to submit a report before the court by October 21.
The court directives came following a hearing on a writ petition filed by BM Fahmida Alam, liberation war and democratic movements affairs secretary candidate from the left alliance panel.
The HC also asked the writ petitioner to file a complaint with the election tribunal along with all relevant documents within 15 days.
In the petition, Fahmida alleged that Farhad was involved with the politics of the now-banned Bangladesh Chhatra League.
The HC bench of Justice Md Habiubul Gani and Justice Md Tahsan Ali issued the order after hearing the writ petition.
